A 36-year-old Blaine man has been accused of raping a teenager with autism under his care.

Dustin Edward Banks has been accused of one count of second degree rape, one count of indecent liberties and one county of third-degree incest. The incident occurred between November 2008 and February 2009, when the teenager was 15 years old, according to charging documents filed by Whatcom County deputy prosecuting attorney Eric Richey.

The teenager, who has limited verbal skills, told his grandfather what Banks had done to him after he moved out of state to live with his grandfather at the beginning of 2012. The teenager said Banks had raped him while helping him bathe. He also said that Banks had threatened him with death if he told anyone.

Banks initially denied the allegations, but later admitted to investigators that he abused the teenager sometime in late 2008 or early 2009. Banks maintained the incident was a one-time occurrence, though he continued to help the teenager bathe, according to court documents.

“Banks admitted that he had ongoing conflicts in his mind about bathing [the teenager] because the act caused him arousal,” Richey wrote.

The case is set for a jury trial on June 18, after a hearing June 6 to determine whether Banks is fit to stand trial.
